Q: Is the Red Wing Police Department going to help with ICE raids?

A: Thank you for this opportunity to explain the Red Wing Police Department's role in immigration enforcement. ICE stands for Immigration and Customs Enforcement, which is a federal agency, not a local agency. To understand enforcement of immigration laws, our reference refers to the Immigration Act of 1952, otherwise known as Public Law 414. To summarize parts of this Act, immigration laws are mostly civil, and only enforceable by the agencies identified by the US Attorney General. Section 274 states, “No officer or person shall have authority to make any arrest for a violation of any provision of this section except officers and employees of the Service designated by the Attorney General, either individually or as a member of a class, and all other officers whose duty it is to enforce criminal laws.”

The Red Wing Police Department is not an immigration enforcement agency; we are a municipal law enforcement agency. The mission of the Red Wing Police Department is to "safeguard lives, and protect property, whereby; our community may enjoy a sense of peace and security." This includes every person who is in Red Wing. I can't emphasize it enough that local law enforcement is responsible to enforce state and local criminal laws, which is a separate role than federal immigration enforcement.

Everyone in our community should call the police when they are the victim of or witness to a crime without fear of being asked about their immigration status. The Red Wing Police Department works hard to live by our Values, and continually works to preserve, earn, and build on the trust of every resident within the city limits of Red Wing.

The Red Wing Police Department uniform is a dark blue and has Red Wing on the patch, as do our vehicles. The Red Wing Police Department's role is to enforce state and city laws; we are not an immigration enforcement agency.
